Work arrangements have become a tool for modern businesses aiming to optimise productivity enhance employee wellbeing, and boost employee retention. In the wake of COVID-19, it has become increasingly evident that the traditional 9 to 5 work model may not always be the most efficient or practical choice.

The Employment Relations (Flexible Working) Act 2023 has successfully passed through Parliament. It is now awaiting approval from the monarch. This act introduces changes to the existing process of flexible working;


1. Employees will now have the opportunity to submit two requests for working within 12 months as opposed to one request previously allowed.


2. The timeframe for handling a request is two months; however, an extension can be arranged if necessary.


3. An employee's request can only be accepted with consultation.


4. Employees are no longer obligated to explain the impact of their flexible working request in their application.


Nevertheless, it is essential to note that this change does not grant employees a Day 1 right" to work. Instead, employees must still complete 26 weeks of service before becoming eligible to make such a request.


There is no requirement for offering a right of appeal, although the ACAS Code Of Practice does recommend it. Additionally, when it comes to consultation, there are no minimum timeframes or expectations outlined.
